I swear the laws change daily, so maybe someone can help me. What are the current possesions laws? I heard under an ounce is simply dealt with shaking it out infront of you, crushing it and giving you a fine, unless of course its in little baggies.
Then there's growing.
Something about being charged for how many lights you have, not how many plants you have?
ANd in reference to the first point, are you able to be pardoned for past offences?

I don't think any of that has actually made it into the criminal code. Technically speaking, simple possession is just as illegal as it ever was. In recent times courts have not been interested in hearing small-potatoes cases and so perhaps some of the guidelines you mentioned are simply what cops ask themselves whether something is worth taking to court or not. They know in most cases it isn't.
There is absolutely no doubt that Canada has spent the last decade(s) dragging its feet on any real changes to legislation. I think they know they're going to have to eventually. I don't know if you've ever read the Le Dain commission report of 1971-1972. Basically it recommended legalization (and if not full legalization then at least decriminalize). The american study at the same time, had similar recommendations but the lovely R. M. Nixon made sure it never saw the light of day. He had run his campaign after-all on a hard-line of getting tough on crime; Drug crime being the poster-boy.

http://www.gc.ca I had a poke around and it wasn't immediately obvious how to download the criminal code. Its prolly in there for the taking though. The justice canada website appears to be down right now as well.

You can be pardoned for many (if not all) past offences, but obviously results would vary depending on how the government assesses the severity of the crime. All pardons are on a case by case basis, and reviewed separatly and according to whatever circumstances the pardon is being asked for. I doubt there is one answer to any of that, except to say if the Government decides finally to decrimalize (or legalize) marijuana, then they will have no choice but to automatically pardon everyone with a record for simple possession.

I hate to say it but our country is weak and indecisive!

weed legal or not, its gonna be smoked... cops, deal with the growers and dealers... not with the smokers. Walk around smoke a joint, it doesnt' matter... just dont be one of those idiots that blows smoke everywhere just because they FEEL weed Should be legalized and therefore are able to smoke it anywhere anytime without consequence... If ever it becomes actually legalized, the decision to do so will not be made from any other standpoint but economic. The gorvernment knows there is a shit bucket of money to be made on the stuff, they simply haven't figured out how to capitalize on it without admitting that they've fucked up. The government is legitimately pissed that organized crime gets all the booty, but they're too weak to take over the job.

You're partially correct Griphin that our government is not interested in pissing off the yanks, but we still tend to do things our own way. Hell, the american authorities are pissed off that we are so tolerant of weed smoking as it is now.

Even the Staes will *eventually* see the light on the issue. It will most likely have to wait until a serious downturn in their economy, which you can mark my words is just around the corner. Mr Bush has borrowed more money than all previous presidents combined, and there isn't a hope in hell of the stock market ever sustaining that kind of debt.

The american empire will fall in our lifetime, and Canada better have its shit together when it does. Its not looking good currently.

Weed should be in the same category as Beer. You can drink beer at 19, buy it at licensed facilities, make it in your own home (up to 125 cases a year), go into business as a microbrewer or work for Labatts. Treat weed the same way, the Dutch will buy all we can send.

I used to smoke alot of dope but I find now that it demotivates me too much so I only smoke a couple times a month. I've always felt we should follow the notion "If it aint broke dont fix it".

I cant remember the last time I couldnt find a joint or two when I wanted one. I also agree with the guy who said not to walk around blowing smoke around town trying to get a point across because that'll make it worse for casuals and activists alike.

As far as getting caught goes, I've never been in trouble with it in all these years except for getting a couple dubs taken away. So don't walk around with a months supply of smoke and you shouldn't be having any issues. - Mon, 13 Feb 2006 5:36pm
