I suggest building a pillory at the entrance to every nightclub in town. Obnoxious assholes can be locked in them by the bouncers and the rest of the club's patrons can throw beer on them etc. for awhile until that gets boring. A Victoria man wants some answers after he and his girlfriend were handcuffed by a doorman at Diego's nightclub Saturday evening.
The incident occurred at about 10:30 p.m. Saturday when Larry Jeffries said a friend who was with his group was caught rolling a joint of marijuana in a stall in the men's washroom.
When the doormen were subsequently escorting the man out the door of the establishment, Jeffries said, he and others in his group approached the doormen to ask them why their friend was being removed from the nightclub. Shortly afterwards, Jeffries was handcuffed on the ground.
"I was totally shocked at the way the doorman was treating me when I was just trying to talk to him," said Jeffries, who added that he was on his second beer when the incident occurred.
When his girlfriend, Rosalie Roseberry, intervened she was also handcuffed by a doorman, Jefferies said.
"I believe that it was accelerated by the door staff pushing me," Jeffries said.
While Diego's manager Wally Meng didn't witness the incident, he acknowledged that the establishment's head doorman handcuffed two patrons. But Meng said the doorman in question presented him with a "certificate" indicating he was qualified to handcuff people in the appropriate circumstances.
"That's why I don't stop this doorman from using handcuffs," he said.
The doorman, Meng added, is a former police officer from Ontario who operates his own security company when he's not working as a doorman at Diego's.
And that doorman, he stressed, is the only employee at Diego's who is permitted to use handcuffs.
Jeffries and Roseberry have filed a complaint with Saanich police with the intention of laying criminal charges against the doormen involved in the incident. Jeffries said he was also pushed by one of the doormen before being handcuffed.
As well, Jeffries has sought legal counsel to discuss possible civil action.
Meanwhile, Meng said the club is contemplating charges against Jeffries and Roseberry alleging they were aggressive to the staff. Meng said Jeffries pulled out a chair to use against one of the doormen.
Jeffries, however, said he picked up a chair but had no intention of using it against the door staff as he was simply setting the chair down to establish a barrier between him and the doormen before being handcuffed.
"I grabbed the chair to put some distance between myself and the doormen," he added.
The individual who was caught rolling a joint in the washroom should have been given a warning rather than being ejected from the establishment, Meng said.
However, Meng said he supports the actions of the door staff concerning the use of handcuffs on Jeffries and Roseberry.
Using the handcuffs is an effective way of controlling someone and "reducing violence," Meng said.
It would be different if police were to inform him that handcuffs could not be used on patrons or that it is illegal to do so, Meng said. In that case he would immediately put a stop to his head doorman using handcuffs.
Saanich police Const. John Price said the law concerning what type of restraint can be used against a violent person by any member of the public, doormen included, falls under Section 494 of the Criminal Code. The section states that anyone can arrest someone who is committing a criminal offence, but, at the same time, must also immediately turn that person over to police.
Nothing in that section prohibits the use of handcuffs, Price pointed out. But police will still investigate any allegation that handcuffs were improperly used by a doorman, he said.
Saanich police don't have a position on whether doormen should be allowed to use handcuffs as they have never had to address that issue before, Price said.
"It's not our place to comment at this time because we're just looking into it - it's new to us," he said.
It has only become apparent to police during the past two weeks that a doorman at Diego's has used handcuffs on customers who allegedly cause trouble, Price said. The only way police can address the issue of doormen using handcuffs, he said, is by examining each case individually and determining if using handcuffs is necessary.
"It's like our officers: if they deploy handcuffs, they have to be able to articulate why they deployed handcuffs in a certain situation," Price said.
He said he didn't have any knowlege about the doorman possessing a certificate authorizing to use handcuffs.
During a law enforcement career that began with the Vancouver Police Department, Price said he's never heard of a doorman using handcuffs on a patron.
"In my 15 years of policing - and three of those were down in skid row in east Vancouver - I've never come across a bouncer using handcuffs," he said.

From what I hear, from people who work there, is that this guy hit a bouncer and kicked a waitress's full drink tray into her face, also catching and ripping off her skirt in the process.

I'm surprised he *only* got handcuffed.

I was chattin' with a saanich cop last night about this, and he said that basically it's legit to handcuff people even if you aren't a cop, but as soon as you restrain them, you are 100% responsible for their well being.

But after hanging in that club, and seeing what kind of crowd exists there at 2am, it really doesn't surprise me that the bouncer used cuffs. And if we were to implement zippy's idea, they would need a pretty big room out there... - Sat, 5 Feb 2005 7:12pm

I personally know the doorman involved in this situation and although I don't know exactly what happened here, I can say that he is a pretty level headed guy who doesn't fly off the handle. He is a professional who does his job well and has to deal with a lot of idiots. Does anyone really think that that guy picked up a chair to do anything other than swing it? Not a chance. Handcuffs are a method of restraining someone when there may not be another option rather than beating them down. Thats why the police use them. If he had punched this guy, everyone would be bitching about that. It really is a no win situation. The fact is that booze doesn't make anyone smarter and it makes some people violent and aggressive. There is no 100% effective solution to this problem other than not allowing people to drink but that would suck for everyone. These guys should have rolled their joint in their car and smoked it in the parking lot. Problem solved for everyone.

The drink minimum was passed by city council - bar owners had nothing to do with it. Well, THIS bar owner had nothing to do with it, anyway.

That said, you can't make money selling a bottle of beer for $2.50 in a bar. Maybe at a rent party...

Best way to deal with a bouncer is to first not instigate anything at all.Then if they fuck with you (throw punches for no reason,grabs you) kick their ass and expect to throw some boots in every direction after he hits the floor (they like to gang up on ya).Its called self defense at a certain point.You must give not them a reason to use force (they,ll find one trust me,thats what some of them want).I have been through all the shit going through bars in Detroit for years.Bottom line.ANY reason for someone swinging at you for no reason is cause for self defense.I,ve even kicked cops asses and had the assault reversed.Know your rights man.Happy ass kicking.Signed:Undefeated. - Thu, 10 Feb 2005 2:20pm
