The RIAA may offer to turn a blind eye if people promise to delete files
The US music industry has started legal action against hundreds of people accused of sharing music files without permission online.
The lawsuits, filed in federal courts across the United States, had been widely expected.

The legal action is controversial, with many observers accusing the Recording Industry Association of America (RIAA) of being heavy-handed.

Those found guilty face fines of up to $150,000 (�100,000) per song swapped.

Exactly 261 people received lawsuits on Monday on behalf of Universal Music Group, BMG, EMI, Sony Music and Warner Music, following the RIAA's announcement in June that individual file-sharers would be targeted.

RIAA president Carey Sherman said he hoped the legal action would prompt parents to pay more attention to potentially illegal activities by their children.

"We expect people to say 'It isn't me, it was my kid,' but someone has to take responsibility," Sherman said.

More lawsuits are expected to follow after Monday's initial set.

The actions resulted from subpoenas sent to internet service providers and others seeking to identify roughly 1,600 people the RIAA believes engage in illegal music sharing.


Despite the $150,000-per-song possible fine, the RIAA has said it would be ready to come to an agreement on each case.

The recording industry is also expected to announce an amnesty for people who admit they illegally share music online.

They must, among other things, promise to delete any illegally downloaded music and not swap files illegally again.

But those people targeted by Monday's lawsuits would be ineligible.

Here's a point nobody ever brings up when these giant record companies start to whine about lost revenue due to piracy.

In the 80's when they switched formats to CDs from LPs and cassette they upped thire porfits significantly.

In 1986 it cost $3.49 per unit for vinyl lps in runs around 1000. In 2004 CDs can be manufactured for $1.25 per unit approximately. Do the math, the record companies forced everyone to re-purchase their record collections on CD at higher prices while their manufacturing costs were less than half of what they were.

Get it? They charged more for something that cost them less to create and had almost guaranteed sales for people doing lp replacement. That went on for over a decade and nobody was crying the blues for the poor customer were they? What did they do with all those extra profits they made? Why didn't they use those extra profits to avoid the situation they are in now? Because they snorted it up their greedy coke filled nostrils thinking it would never end and now we're supposed to feel sorry for them.

I hope the record companies are hurting. They deserve too. I hope they collapse and are replaced by a plethora of independent labels doing business based on a completely different mode. Internet sales and orders.

Perhaps CD sales have plummetted because baby boomers have finally finished re-buying their LP collections and have gone back to normal music consumption. Maybe the piracy thing is a complete red herring to allow the record companies more of a monopoly on the music business. - Wed, 10 Sep 2003 1:50pm

One word: Backcatalog, see I remember reading in some book that EMI took a chance on the Sex Pistols because EMI was surviving off the Beatles backcatalog and even if they lost $1 million they could call it a business writeoff and still be in the black. Must agree with you on the Vinyl > CD point, I've been saying the same thing for years now. And if you look at how many other formats there have been (reel to reel, 8-track, cassette, etc.) the labels are making up to 5 times the profit off one release. It's a strange argument this music stuff, I mean what's next, RIAA targeting and sending out court orders to 12-year old girls (oh, wait a sec.... :) Perhaps something good will come out of this mess, SUPPORT INDEPENDANT MUSIC!!!
