Due to the lack of any and all required licenses for live music, booze w/o food service and a decent capacity (more than 40!) the Brickyard shows I have booked are all cancelled. A huge apology to all the people this is going to affect. Turns out the venue was being targeted by a few Yates Street merchants who didn't want the hassle of a live venue near by and they were the ones who called the liquor inspector. Again, I am sorry this has happened. I had no idea this was how this would end up.

I think that some local political organizing is going to have to happen here. This is our town and the local bureaucracy needs to keep in mind that there are others that pay taxes here besides whomever was complaining about the Brickyard (if there even were any complaints, that could be total bullshit for all we know).

The Brickyard ran into this exact problem back in 2000. The problem with their licencing is that they do not have a cabaret licence that would allow them to serve alcohol and have live music. Back then it was the hotel across the street making the complaints. I'm sure it still is.

I was really looking forward to playing there this weekend since I played my first show there almost ten years ago to the week. I kind of figured it would go down this way though. - Fri, 1 May 2009 10:33am

some interesting comments guys. as far as ME knowing about the licensing issues before hand, you are partly correct. The thing is, I am not the venue owner. I was contracted by the owner to organize these shows. Like an idiot, i assumed after owning the biz for more than 6 years, he would know what he was allowed to do in the space. I just can't believe he let me move forward on all this without the right licenses. Yes, I agree it was his fault for trying to do all of this under the radar.

And for anyone who cares, it was the ODEON THEATRE who called the liquor inspector.

We got nailed for no Cabaret license - which allows live music and liquor service - over capacity (which is 40) and serving liquor to people who weren't eating. And no, I don't believe you need a special license for live music but you do if there is going to be dancing and liquor service as well. - Sat, 2 May 2009 10:16am

Hmm. Shows what I know. Our liquor license doesn't say anything about music or entertainment. Too bad, anyway - I fuckin' CAN'T STAND IT when people maliciously fuck with someone trying to make an honest go in business. Someone made a comment about a rally and in turn someone said it was stupid, but I don't think that it's that far fetched. When it comes to liquor licenses, Vic PD have the final say on liquor primary and they don't want anyone getting them cause it causes to many problems for them. something silly like 3 new liquor primary licenses in the last 10 years, the new places you see popping up are currently existing ones. Andrew from STEAMERS was able to sell his license for $600,000. That gives you an idea of how much people want to get a hold of one.

Not surprised it was the Odeon owner. Guy's a real fucking prick. He owns the stretch from the brickyard to the small store on the alley. A friend of mine used to hang out in piss alley selling weed. The small store there, as well as the surrounding businesses like the pizza shope that was in the alley, loved him being there as it cut down the graffiti and junkies. The reason the Brickyard can't have live bands is cause the hotel across the street bitched to City Hall regarding the Birth of Sickess fiasco (killer set, noone destroyed anything, we all got rather drunk), so if Jake books any bands and brags about booking Brickyard gigs he should look into licencing.

i appreciate your comment Matteus but as for your comparison of my situation and that of a hit-man murdering someone, c'mon dude - the guy has owned the business for almost a decade, it's not my place as a contracted promoter to hold his hand and ask him if he's allowed to actually house live music etc...

yes, i take ownership of this - but it was his job to inform me of the obvious risks. If I had known we were trying to fly under the radar I would have booked one show and tested the waters - not organized over 2 months of dates.

This is a very unfortunate situation, and all parties are to blame, but to be honest, the only reason why ANY of this went down is because Jake was doing what he thought was the right thing by informing Pierre of the shows that he had booked. He was being honest to Pierre and in any NORMAL situation with a NORMAL person this would be the right approach, but, with Pierre it isn't.
I am the manager of the Brickyard, and we were booking shows before Jake got hired, and not informing Pierre of any of this, and nothing came out of it but a good time. THE MINUTE Jake told Pierre about any of this I guarantee he was on the horn to the liquor inspectors. The guy HATES anybody having a fun time, and he also hates "hoodlums" outside of the Odeon "scaring" away his customers. Jake wasn't FULLY informed of what was going on with the liquor licensing, and I haven't been either and that is why I am meeting with them at 2pm today to hopefully smooth some things over and find out what we CAN and CANNOT do.
