Saw the strangest thing when I was at the Swiftsure Lounge yesterday. On the wall close to the audio equipment was a SOCAN Certificate of Performing Right Licence; Tarrif(s) 3a - Live Music. What I'm curious about, do any of the live venues in Victoria pay SOCAN fees? I didn't even know such a licence existed (they got there certificate April 1, 2010, so originally I thought it was a joke).

I know a certain museumn is licensed. Spent a lot of time tracking down early vancouver bands SOCAN, amongst the X-files theme and more known audio you might hear a beautiful string arrangement from Shadow's on a Dime Ferron's masterpiece. In lieu of the K-tels vacation tip you'll also hear the modernettes doing Teen City. - Sat, 5 Feb 2011 10:01pm

My experience with Socan goes back prior to their conception, when it was Capac.
Capac was a worthwhile organization. You got paid for what you did. I used to do some stuff with local TV and FM radio, and you were paid according to air play time & duration. This was arrived at by the stations submitting the information in the form of a play log.
Capac led the way to Socan and when I saw what they (Socan) were doing, I disassociated myself.
Here's a for instance:
Let's say there's an obscure little song writer, and he or she likes to write songs about clouds or trees, rocks or twigs, I'm sure you know the type of stuff.

Now let's say I own a business, like a small store, and I want to play my collection of Billy Holliday music, which I have already bought, for background ambiance.

What Socan is saying is that I would have to pay them a fee, and those monies would go into a general pot, which is supposedly distributed amongst the likes of our little "clouds & trees" song writers, despite the fact that I would never own a CD of their's, let alone play or listen to any of the songs.

I think it's safe to say that Billy Holliday's estate is not going to see any of the money Socan hopes to collect.

…..and let’s not forget that their "Board of Directors" take a hefty portion of those fees along with "administration" costs.

It's poorly set-up, poorly organized, and you've got people getting paid or wanting to get paid for stuff that never gets air time, and their CD sales for the year might amount to maybe 4 or 5 CD's, if that.

It's a money grab for "artists" whose material will never see the light of day.

Our cover band played a dance at a Yacht Club a few years back. Our set lists consisted mainly of 50's & 60's classic rock & roll,, 'cos that's what they asked for.

Well, Socan got after the Yacht Club, to collect the amount of $96.00
Here's the breakdown: If there's dancing, it's $96. If there's no dancing: $48.
Don't ask how these figures were arrived at.

So the Yacht Club was billed for $96. They quite cleverly turned around and billed Socan $96 for administration fees (somebody's gotta make out the cheque...am I right?)

Needless to say.....no money changed hands.

These days with the advent of material made available on line...I would hope that bands / musicians, would make their money by actually going out and playing, promoting their material, PayPal, do the concerts, or the small venues, hand out the business or contact cards. If people like your music enough, they'll seek you out, to get their own copy, and if they don't, then don't expect to be paid for nothing. If your CD sells in the stores, or on line, or at your live concerts....there ya go.

Socan collects, or would like to collect payment from live performances, including live theatre, dances, weddings, even the background music played in your dentist's office, in your downtown shops, or even on public transit. Hell, for a while they were even gonna try and suck money from the causeway buskers. I don't know what became of that.

Now....these monies are supposedly distributed to artists (members of Socan)

This basically means, that if you're having a wedding reception for your son or daughter, and you supply your own music, let's just say for argument's sake, your complete collection of The Beatles......

Now I'm just guessing here, but I would doubt that the likes of Paul McCartney would be a card carrying member of some piddly Canadian music association. You can get the membership list on line btw.

Socan expects to be paid, and distribute those monies to Socan members. Not to Paul McCartney, or Lennon's estate, but to "Socan" members....why...I have no idea.
Believe me, I contacted them and asked...and they couldn't give me an answer, and are very evasive when questioned about it.

^^Great post! And even BETTER idea re: billing SOCAN!^^

I've received two cheques from Socan ... one at the end of summer for about $5 & another a couple days ago for $6.98.

I suppose I should be glad to recieve that, but then I think: "what is the real point"?!? Is this money helping me? Is there really a whole staff behind the scenes figuring this out & cutting the cheque?!?

What I find really irritating is that Socan had recently approached friend's record store after getting wind of their free in-store shows (which they've been doing for years - albeit, much more frequently as of late) & looking for a cash-grab ...

The bands that are actually playing the shows don't see any money, the store owner is actually more put-out for doing the shows (supplying food/beverages for the bands, not much shopping during the perfromances, etc) ... but there's an agreement/mutual benefit between both parties. Why this third party in an office back east should be collecting money (that was never even generated from the show) is pure bullshit.

Although their 'annual fee' was not very much, it's just one more detraction to the music community rather than any '$5 cheque' could benefit. - Wed, 16 Feb 2011 2:08pm Edited: Wed, 16 Feb 2011 2:35pm

As shboom already mentioned, the license you saw applies to cover songs that performing bands invariably do. The venue is assuming that this license will protect THEM much more than the bands they hire, but there might well be some kind of mutual protection in a roundabout way.

Even local record stores, as they play LPs or CDs or whatever during the day will eventually be asked by socan to pay yearly fees for those 'performances'

Its a few hundred bucks per year, but what burns me is that in a used record place the reason they are playing music is to sell more of the same artists music! (and also to sell more music in general of course)

I'll leave by saying that the music machine is so screwed up, that they dont realize playing a second hand LP (which the industry make no money from) DOES lead to sales of music for which they DO still make money on... - Thu, 14 Apr 2011 8:58pm Edited: Thu, 14 Apr 2011 9:04pm
