People in working bands: what sort of registration process do you have to go through once you've got a name..do you have to copyright it or register it as a company name? Socan? Or do you just cross your fingers and hope that no one else starts a band with the same name? - Fri, 19 Mar 2004 10:57am

If you want to secure your name for sure, you have to shell out the $ and get a copyright, no way around it, I had to shell out something like 60 bux to copyright some video game shit about 2 years ago, not too sure of the proccess as my partner handled it from the UK, but I'm sure meatlocker must know??? - Fri, 19 Mar 2004 11:13am

I'd say pick a name that no one else wants.
It is near impossible to protect your name outside of North America. The U.S. Library Of Congress is a good place to register though. They do the copyright stuff. Their contact info escapes me right now, but I am sure they are easily found on the net. I just got home from work, so I am too lazy to look.
SOCAN couldn't hurt either. They have online registration now, although I think for them and the Library O' Congress you may need a tangible release to validate your entry.
That is all we have done and there have been no problems. Of course, being around for almost ten years with the same name doesn't hurt either.

Actually, you have to TRADEMARK the name - you can't copyright it, as that applies only to content type stuff - like a song or a novel. SOCAN and the Library of Congress are not accurate -- SOCAN does not mean you have copyright on your songs, and definitely not on your name, Library of Congress Intellectual Properties Office in Washington copyrights your song, not your name. Though SOCAN does have rules about not duplicating Publishing Company Names (but it's still not copyright/trademark). You do automatically get a trademark as you use your name, and if you use it on the Internet, it is world wide. HOWEVER, if someone else can prove they've been using the name longer, or has trademarked the name officially, OR just has more money that you - you could be screwed. You can check Indiepool's 40,000 indie artist listings http://www.indiepool.com, or http://www.bandname.com, ubl.com or allmusic.com to see what names are being used out there to start with. Then, check (and read!) the government CIPO site for Trademarking information. http://strategis.gc.ca/sc_mrksv/cipo/tm/tm_main-e.html It costs $250 if you register online. They also have a list of trademarks you can check. It would be wise to trademark worldwide officially as you get more well known. Also, BUY YOUR DOMAIN NAME AND KEEP IT UP (at the very least)! If you let it die, it could get porn or crap on it.
