Does anyone know how rights work when you're recording a cover, we want to record one but we're afraid it will be too expensive or we'll get fucked if we don't get rights. - Sun, 15 Feb 2004 11:05am

If you want to do it legally, you will probably want to research who has the rights to the song you want to record, get in touch with them or their management and ask for permission. They will probably want you to pay a fee or will want to hear the song before they say "yes", in case you do a shitty redition of their song. :)

Personally, if you're serious about this, I'd recommend talking to a real music lawyer, someone who deals with the music industry for a living, not some guy who does traffic violations or divorces. That way, you're covering your ass and you'll be sure that you don't get fucked in the future by it.

Yeh , unless you have the song on the Radio , or somehow manage to make a shit load of money off of it than who cares. They can probably file a law suit but unless they are acctually loosing money there would be no point. My attitude says go ahead and do it. What are they going to do ?? ..... Kick in your door and take your drums and amps. Fuck EM. - Sun, 15 Feb 2004 4:11pm

I know that when I contacted the Smut Peddlers about recording their song "Hoosegow" they were thrilled. The way they see it, as long as they're getting songwriting credit for it, they're getting their name out there. I'm sure that if the record took off(yeah right!), we would have to work some kind of payment out.
I think that they were shocked that I'd name my band after one of their songs. - Sun, 15 Feb 2004 6:42pm

I think the problem I have with mine that is different than others is that the band we cover isn't some independent act willing to get their name out no matter what, ours is written by whoever writes the music for a certain British girl band. anyway, its a hilarious cover that I want to record but Im sure if on the off chance we were ever found out, the bigwig writers wouldn't be as lenient as a local indie band. - Mon, 16 Feb 2004 9:54am

If you want to press the song on CD you will need to get a mechanical publishing license. The easiest way to do that is to contact CMRRA in Toronto...

Canadian Musical Reproduction Rights Agency Ltd
320 - 56 Wellesley Street West
Toronto, Ontario M5S 2S3

416-926-1966 http://www.cmrra.ca

The standard rate is $.077 per song/CD payable prior to manufacturing. - Mon, 16 Feb 2004 12:44pm

Uhm,....I think Ross is still working on his degree in music & entertainment law ;-)

I'd go with Michael's advise above on CMRRA.

If you're gonna release or sell in the US, you should also contact The Harry Fox Agency for US mechanicals; http://www.nmpa.org/hfa.html - Mon, 16 Feb 2004 7:47pm
